The ESOS Act 2000 and associated legislation requires all providers who are not exempt from the requirement to pay annual Assurance Fund contributions to be a member of a Tuition Assurance Scheme (TAS), or to claim exemption from TAS membership under the ESOS Regulations 2001.
For information on how to become a member of a TAS, see the TAS operators contact list below.
To claim an exemption from TAS membership under the regulations, a provider
- must have a bank guarantee; or
- be a body corporate and have an indemnity agreement; or
- must be a provider who the Minister believes on reasonable grounds should not be expected to become a member of a TAS.
All applications for exemption must be made in writing to the Minister and must include supporting evidence. For information on claiming an exemption on the basis of a Bank Guarantee, see the Bank Guarantee Guide (can be viewed in either Rich Text Format (73.6 KB) (RTF) file or as an Adobe Portable Document Format (24 KB) (PDF) file). For information on claiming exemption on the basis of an Indemnity Agreement, see the Indemnity Agreement Guide (can be viewed in either Rich Text Format (543.2 KB) (RTF) or as an Adobe Portable Document Format (86.4 KB) (PDF) file).
